Wage and Hour Claims

The Fair Labor Standards Act (FLSA) and Minnesota and Wisconsin wage laws set the ground rules for pay: minimum wage, overtime at time-and-a-half for hours over 40 in a week for non-exempt employees, and timely payment of earned wages. Despite these rules, wage violations remain among the most common workplace legal problems — and they often affect entire groups of workers at once.

Common violations

  • Unpaid overtime, including “off the clock” work before or after shifts
  • Misclassification of employees as exempt from overtime
  • Misclassification of employees as independent contractors
  • Illegal deductions, tip violations, and unpaid commissions or bonuses
  • Failure to pay final wages after separation
